Phytomer and Andaz Miami Beach Resort & Spa 2026 Wellness Giveaway Official Rules

NO PURCHASE OR PAYMENT NECESSARY TO ENTER OR WIN. A PURCHASE OR PAYMENT WILL NOT INCREASE YOUR CHANCES OF WINNING. ODDS OF WINNING WILL DEPEND ON THE TOTAL NUMBER OF ENTRIES RECEIVED. VOID WHERE PROHIBITED BY LAW.

Eligibility:

Phytomer and Andaz Miami Beach Resort & Spa 2026 Wellness Giveaway (hereinafter referred to as "Giveaway") is open only to legal residents of the fifty United States who are 18 years of age or older at the time of entry. Employees of Phytomer Corporation, Hyatt Corporation (“Prize Partner”), their parent companies, and immediate family members (spouse, parents, siblings, and children) and/or those living in the same household of each are not eligible to participate. The Giveaway is subject to all applicable federal, state, and local laws and regulations. Void where prohibited. Prize Partner is not responsible for the collection, submission or processing of entries, the administration of the Giveaway, or the selection of the winner. Entrants are supplying their information to Sponsor and not to Prize Partner.

Sponsor:

The Giveaway is sponsored by Phytomer Corporation, 952 Woodoak Lane, Salt Lake City, UT 84117.

Giveaway Period:

The Giveaway begins on August 1, 2026, at 9:00 AM Mountain Standard Time (“MST”) and ends on August 31, 2026, at 9:00 AM MST (hereinafter the “Giveaway Period”).

Entry:

To enter the Giveaway, participants must follow the below entry methods and rules.
Entries that are incomplete, illegible, corrupted, or otherwise not in compliance with these
Official Rules may be disqualified at the sole discretion of Phytomer Corporation.

 

• Limit of three (3) entries per person, per Instagram account, email address, and per
mobile phone number for the duration of the Giveaway Period, regardless of method of
entry. Entries received from any person, Instagram, email address, mobile phone
number in excess of the stated limitation will be void.
• Online entry will be available for the duration of the Giveaway Period by visiting
PhytomerUSA’s Instagram profile (phytomerusa) and following the directions provided
to enter. To qualify for online entry, applicant must provide evidence that:

 

°  Applicant “Liked” and “follows” Phytomer & Andaz Miami Beach Resort & Spa
on their respective Instagram accounts (@phytomerusa, @Andaz Miami Beach)
If applicant does this, applicant will receive one (1) entry.
° Applicant completed and submitted a product review on the Phytomer website
located at www.PhytomerUSA.com. If applicant does this, applicant will receive
one (1) entry.
° Applicant tags two or more people on the official PhytomerUSA Giveaway post
or shares PhytomerUSA Giveaway post on their Instagram story. If applicant
does this, applicant will receive one (1) entry.

 

Alternative Method of Entry:

Mail-in entry will be available for the duration of the
Giveaway Period. On a card, print your full name, complete address, phone number,
date of birth, and email address and mail in an envelope with proper postage affixed to
the following address: Phytomer Corporation, 952 Woodoak Lane, Salt Lake City, UT
84117.

Mail-in entries must be hand-printed and each entry must be mailed separately.
All mail-in entries must be postmarked by August 21, 2026, from within the
United States of America.

 

Prize Expiration Date:

Giveaway Prize Package (defined below) must be used by winner within twelve (12) months after the date of Giveaway Prize selection.

Winner Selection and Notification:

One (1) potential winner will be selected at random from all eligible entries received during the Giveaway Period. The potential winner will be notified via Instagram, email, or by using the contact information included on the winner’s postcard on or about September 5, 2026, by a representative of Phytomer Corporation. The potential winner must comply with all terms and conditions outlined in this document. If a potential winner cannot be contacted, fails to reply to the notification within the required time period (one week), or is disqualified for any reason, the prize will be forfeited, and an alternate winner will be selected by random drawing from among all remaining eligible entries. Attempt to award the prize will be made in the discretion of the Sponsor up to three (3) times. Prizes: The “Prize Package” includes (Total ARV $5,060):

• One (1) airline voucher or gift card in the amount of $1,500 towards economy advanced
booking airfare for two (2) individuals from the closest major airport to winner's location
of residence to closest major airport to Andaz Miami Beach Resort & Spa located at
4041 Collins Avenue, Miami Beach, FL 33140, courtesy of Phytomer Corporation.

 

• The prize consists of a two (2) night stay for winner and one (1) guest in a room of
Supplier’s choice at Andaz Miami Beach Resort & Spa. Prize or part of the prize may be
awarded in the form of a gift certificate, which will be emailed or mailed to winner
following verification. Winner should follow the instructions on the gift certificate to
complete booking. Subject to availability and possible blackout dates as determined by
Sponsor. An advance booking is required for stay. Standard guest policies apply to
booking and stay and normal arrival / departure restrictions apply. In accordance with
such policies, winner will be required to provide a credit card at check-in to cover
incidentals and damages, if any. Winner’s guest(s) in connection with the use of the prize
must be the legal age of majority. Stay must be booked and completed by September 30,
2027 (Total ARV of Prize 1: $1,500 USD)

 

• The prize consists of a two (2) professional spa treatments for winner and one (1) guest
each at the Ondara Spa, located at Andaz Miami Beach Resort & Spa.

Prize or part of the prize may be awarded in the form of a gift certificate, which will be emailed or mailed to
winner following verification. winner should follow the instructions on the gift certificate
to complete spa bookings. Subject to availability and possible blackout dates as
determined by Sponsor. An advance booking is required. Winner’s guest(s) in connection
with the use of the prize must be the legal age of majority. Spa treatments must be
booked and completed by September 30, 2027 (Total ARV of Prize 1: $1,060 USD).


• One (1) $500 Visa gift card to be used towards meals and local transportation during
the winner's trip and two-night stay at Andaz Miami Beach Resort and Spa, courtesy of
Phytomer Corporation.


• One (1) $500 product voucher to use on phytomerusa.com towards the purchase of
complimentary Phytomer products, courtesy of Phytomer Corporation.


• No cash or other prize substitution is permitted except at the sole discretion of the
Phytomer Corporation. The prizes are non-transferrable. Any and all prize-related
expenses, including without limitation any and all federal, state, and/or local taxes,
shall be the sole responsibility of the winners. Acceptance of a prize grants Phytomer
Corporation permission to use the winners' entry, name, and likeness for advertising,
promotion, and trade without further compensation or remuneration unless prohibited
by law.

Terms & Conditions

By participating in the Giveaway, participants agree: (a) that travel restrictions, conditions and limitations may apply, (b) to will be solely responsible for obtaining any documents necessary for travel and for their own and any guests conduct while participating in the Prize Package, (c) to comply with all applicable laws, rules, and regulations pertaining to use and enjoyment of the Prize Package including but not limited to the consumption of alcoholic beverages, (d) that the sponsor shall not replace lost, mutilated or stolen tickets, travel vouchers or certificates, (e) that they are their guests may be require to execute additional waivers and releases as a condition of receiving the Prize Package, and (f) to release and hold harmless Phytomer Corporation, Prize Partner, their respective parent companies, affiliates, and each of their respective directors, employees, and representatives from and against any claim or cause of action arising out of participation in the Giveaway or receipt or use of the Prize Package.

IN NO EVENT WILL SPONSOR, ANY PARTICIPATING PROMOTIONAL COMPANIES, RELEASED PARTIES, OR PRIZE PROVIDERS, OR THEIR RESPECTIVE PARENTS, AFFILIATES, SUBSIDIARIES, OR RELATED COMPANIES, THEIR ADVERTISING OR PROMOTION AGENCIES OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, REPRESENTATIVES, AGENTS, SUCCESSORS, OR ASSIGNS BE LIABLE FOR ANY DAMAGES OR LOSSES OF ANY KIND, INCLUDING INDIRECT, INCIDENTAL, LOST PROFITS, CONSEQUENTIAL, OR PUNITIVE, MULTIPLE, OR ADDITIONAL DAMAGES.

Any other costs associated with the Giveaway Prize not included in Prize Package details above are the responsibility of the recipient of the Giveaway. Phytomer and Prize Partner are not responsible for any travel delays, cancelled flights or any other harm or expenses which may come about as a result of the Giveaway. Once dates have been selected and trip arranged, Phytomer and Prize Partner are not responsible for any added costs that may come about as a result of winner changing trip dates.

If a potential winner is considered a minor in their jurisdiction of residence, Phytomer Corporation reserves the right to disqualify them and award the prize to an alternate person.

Phytomer Corporation reserves the right to cancel, suspend, and/or modify the Giveaway, or any part of it, if any fraud, technical failures, human error, or any other factor impairs the integrity or proper functioning of the Giveaway, as determined by Phytomer Corporation in its sole discretion. In such an event, Phytomer Corporation reserves the right to determine the Giveaway course of action from that point forward. Phytomer Corporation reserves the right, in its sole discretion, to disqualify any individual it finds to be tampering with the entry process or the operation of the Giveaway or to be acting in violation of the Giveaway guidelines or in an unsportsmanlike or disruptive manner.

Disputes:

Participants agree that any and all disputes, claims, and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action. Except as otherwise indicated, all issues and questions concerning the construction, validity, interpretation, and enforceability of this document, participants' rights and obligations, or the rights and obligations of Phytomer Corporation in connection with the Giveaway shall be governed by and construed in accordance with federal laws.

Privacy:

Information collected from participants is subject to Phytomer Corporation’s Privacy Policy.

Instagram Disclaimer:

This Giveaway is in no way sponsored, endorsed, administered by, or associated with, Instagram or Meta. Participants understand that they are providing information to Phytomer Corporation and not to Instagram. The information provided will only be used for the administration of this Giveaway and in accordance with Phytomer Corporation’s privacy policy.

Miscellaneous:

The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision. In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, such provision shall be deemed modified to the minimum extent necessary to render it enforceable and the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein. Sponsor's failure to enforce any term of these Official Rules will not constitute a waiver of that provision. Headings are solely for convenience and will not be deemed to affect the meaning or intent of the Official Rules or any provision hereof. In the event there is a discrepancy or inconsistency between disclosures or other statements contained in any Giveaway-related materials and/or the terms and conditions of the Official Rules, the Official Rules shall prevail, govern, and control.
